YARD/ MARINA RULES & REGULATIONS

2005




PREFACE
The Rules and Regulations detailed in this booklet are published in the interest of safe boating and in an effort to have an informed membership. These regulations are prom- ulgated for the benefit of all and used in conjunction with the Dartmouth Yacht Club Miscellaneous policies available through the office.

The key to a successful Yacht Club is the mutual respect one member has for the rights of another.

Suggested amendments, additions or deletions to this booklet are welcome. Please pass your written comments to the Management Committee for consideration. The Management Committee is the author of these Rules and Regulations. Membership approval is NOT required to make changes as is the case with By-Law amendments.


SAFETY

All lines and fenders required to secure and protect a member’s boat shall be supplied and maintained by the member. Lines shall be of sufficient strength to provide secure berthing.

No lines, including electrical cords, shall be placed across the marina trunk or marina fingers in such a way as to constitute a tripping hazard.

A speed limit of 4 knots shall be observed in the vicinity of the marina system, starting at the breakwater lighthouse. Excessive wake is to be avoided. This is a common courtesy extended to marina holders to avoid unnecessary stress on lines, damage to boats and personal injury.

No boat shall be secured to a finger in such a way that any part of the boat extended over the main trunk – i.e. bowsprit.

No tender or other obstruction is to be left on any part of the marina system. This includes permanently secured steps, tackle boxes, etc.

Use of naked flame, including BBQs is NOT permitted on the fingers or trunks of the marina system.

Children 12 years of age and under MUST wear lifejackets or certified PFDs at all times while on or near the marina.

Access on, and use of, the marina is at own risk.

A Safety Manual has been published dealing with all safety related subjects. Of particular interest and importance are the following.

It is the responsibility of all members to report any safety issues to the Management Committee or to the office, for corrective action, or other actions as considered necessary by the member of Management. Anyone witnessing a safety violation should inform the person straight away.

FUELING

Fueling is to take place at the Fuel Dock only. Fuel may be transported onto the marina system in proper approved container. Jerry cans may be filled up at the Fuel Dock only. No outside fuel suppliers are allowed to fuel vessels on DYC property.

The hours of operation for the Fuel Dock will be posted on the Fuel Shed door.

The Captain of the boat being refueled is responsible in all respects for the fuelling of his/her vessel. The Fuel Dock attendant will pass the fueling hose to the captain and stand by the pump until fueling has been completed.

Detailed instructions and safety information in respect to the fuelling of a vessel are displayed at the Fuel Dock. The Fuel Dock attendant shall have the right to refuse service to any craft not complying with these rules.

TRAVEL LIFT

The Travel Lift operator shall be the authority when lifting of a vessel. It is at the discretion of the operator to determine if conditions are suitable for the lift of a vessel. A list of Travel Lift Procedures is available at the office.

MAST CRANE

The mast crane is available for use by DYC members. Mast Crane is used at members own risk. Maximum lifting load allowed is 600lbs. This crane is for the hoisting of masts only. The lifting or hoisting of persons is strictly prohibited. Prior approval from the manager is required if objects other than masts are to be hoisted by the mast crane. The use of the spar crane by non members is prohibited unless it is used in conjunction with winter storage or using the marine travel lift. Spar crane is used at members own risk. Please consult with DYC staff on proper operation of Mast Crane.

MAST RACK

Any masts being stored on the mast rack must have their spreaders and any other mounted equipment such as Radars, Wind Instruments, etc removed. The mast must have the name of the person or boat clearly marked on the mast for identification purposes. All lines must be secured when mast is being stored.

SAFETY IS EVERYONES CONCERN


MARINA FEES

The fees for all marina spaces will be set and approved by the membership at the Annual General Meeting. Rates will be published annually. The fees consist of a flat rate marina fee plus a marina surcharge based on the length on deck of your boat.

To retain a marina, a member must have all annual dues and fees paid in full.

Dues for the upcoming boating season, on or before 01 December
Fees for the upcoming boating season, on or before 15 April.

ASSIGNMENT OF MARINAS

The Marina Manager, on behalf of the Management Committee, will have complete authority over the placing of boats on the marina.

When a suitable marina becomes available, and the member at the top of the marina waiting list does not wish to occupy it at that time, their name will be moved to the bottom of the waiting list.

Boats shall be measured to account for the total length of the vessel including bowsprits and swim platforms.

The size (length AND width) of a member’s boat and whether the member has requested 30 Amp electrical power will be taken into consideration when allocating a marina space. Should it be necessary to bypass a member due to the size of their boat, they shall retain their place at the top of the list until a suitable marina becomes available.

The Wait List will be maintained by the Marina Manager with input from Management and the office staff. The wait list is based on seniority (date of joining) and whether the member’s account is current. The member’s name will be placed on the Wait List if the section of the application is marked YES in the Marina Requested section. If, after requesting a mooring the member wishes to go to the marina wait list, the seniority date on that wait list will be the date that the request from mooring to marina is made.
A member will be permitted only one marina space. A member, owning a second boat may purchase daily rental space but only after it has been established that all other members on the waiting list have been given an opportunity to occupy such space.

Requests to change a marina assignment must be made in writing. Forms are available from the office. A list of members wishing to change marinas will be maintained by the Marina Manager, the list will be in order of the date/time the request is received. Verbal requests will NOT be actioned.

MARINA

DYC staff has full authority to move a vessel from its location on the marina if circumstances deem it necessary to move it.

It is not permitted to leave your vessels engine running at the Marina unattended or for long periods of time.

All halyards and other rigging on sailboats must be secured in such a manner as to not have them hitting the mast or other parts of the boat that may cause unnecessary noise.

A noise curfew is set for 11:00pm on the marina. Audio equipment is to be turned down so not to disturb others on the marina system. Please respect others on the marina.

No commercial vessels are permitted on Club Property unless they are performing work at the Clubs request or have requested fueling.

Marine contractors are only permitted on the site to perform repair on member’s boats only. All contractors must submit copies of proper liability insurance and Workers Compensation to the office prior to any work being performed. All contractors must be in compliance with all applicable Occupational Health and Safety guidelines.
No non member shall be allowed to use DYC premises to perform work on their own boat.

RELEASE OF MARINA SPACE UPON SALE OF BOAT

A marina is assigned to a member, not a boat, therefore, when a boat is sold or owner-ship changes, it must be removed from the marina and the Marina Manager advised.

A member who ceased to be a boat owner may retain marina space for the current season and the next season provided they remain a member in good standing with dues and the basic marina fee paid.

Should a member relinquish his marina space because the boat has been sold or the member has elected to move to a mooring, the marina manager is to be advised in writing.

DAILY MARINA RENTALS

Management has the exclusive right to rent vacant marina space.

Members who will not be occupying their marinas for three days or more must notify the Marina Manager or the DYC Office of the specific dates in advance of their departure. Members away must notify the Marina Manager or DYC office at least 24 hours before their return to allow for sufficient time for the marina to be vacated should it have been rented or assigned to another member. DYC staff will rent or assign any marina which has been vacated for 3 days or more regardless of weather they have been notified by the member of their absence.

The private sub-letting of marina by members is strictly prohibited.

The daily rental fee will be published annually.

Marina rentals are charged on a daily basis and are payable in advance

On the last day of a daily rental, boats must vacate assigned marinas by 1400 hrs. Members who have outstanding daily rental charges will not be permitted further rentals.

The marina Wait List shall be followed when offering daily rental space. Members are responsible for ensuring that they can be contacted promptly. The Marina Manager is under no obligation to search for a member who cannot be readily reached.

Marina rentals are for a maximum of two weeks at a time but may be extended subject to availability of space. When moved off because of time, the members name will be moved to the bottom of a marina rental wait list (This is a separate list from the Marina Wait List)

A member who has a special need to rent a marina temporarily or the Service Dock for more than 4 hours should make specific application to the Marina Manager giving details The Service Dock, if used for a period in excess of four (4) hours will be considered to be a “marina” and the applicable marina rental charge applies. This applies to marina holder as well as non marina holders.

No person, either Members or Non-Members, will be allowed to live aboard their vessel on a full time basis during the off season from Oct 15 to May 15.

No vessel either commercial or non-member are allowed to pick up passengers or goods on DYC property. Persons who have paid to use the ramp service or are renting a marina or mooring may be permitted to pick up passengers.

A fee, to be established by the Committee of Management may be levied when a boat has to be moved from a marina for safety reasons or for any infraction of regulations.

MARINA WAIT LIST

The Marina Manager is responsible for the Wait List. The responsibility for maintaining the wait list may be delegated to the Club Manager.

Placement on the waiting list is automatic provided that the ‘Marina Requested YES” has been checked off on the membership application, otherwise the Mooring Fee will apply, or if the member intends to supply his own mooring or will be located other than on DYC property, only the Tender Service/Summer Storage fee will apply.

To maintain a position on the Wait List, all dues and fees must be remitted as required. Dues by 01 December and Fees by 15 April.

Initial placement on the wait list is governed by the date the application for membership is received and the applicable dues and fees paid.

Any member falling in arrears with respect to dues and/or fees will have their name removed from the wait list, or if on the marina removed to the wait list. Once payment has been received, the name will be added to the bottom of the wait list.

A member ceasing to be a boat owner for a period exceeding 12 months will have their name removed from the wait list, unless special arrangements have been made and approved by the Management Committee.

GUEST MARINAS, FUEL DOCK & SERVICE DOCK

Depending on availability, the Marina Manager may designate certain marinas as “Guest Marinas”, typically these would be the “T”s at the end of “F”dock. Member berthing at these slips is prohibited unless prior approval is given by the Manager. Members may berth on a “Guest Marina” to load or unload only, or unless assigned that location by the Marina Manager.

The Fuel Dock is to be used for refueling, pump out, or to take on fresh water only. No boat is to remain on the Fuel Dock unattended. Exceptions to this may be authorized by the Marina Manager upon request.

A four (4) hour time limit on the Service dock will be strictly enforced. Boats exceeding the four hours may be subject to Marina Rental charges. Exceptions to the 4 hour rule may be authorized by the Marina Manager.

Misuse of these facilities will be subject to penalties as determined by the Management Committee.

MOORINGS

The Dartmouth Yacht Club has and will continue to install moorings that may be leased by members desiring a mooring rather than a marina. The club will be responsible for maintaining these moorings, including the anchoring block/chain and ball. It is the responsibility of the member to provide a bridle(s) from the mooring chain/ball to the boat. Moorings will be assigned by the Marina Manager.

Private moorings are permitted but the location of the mooring is at the discretion of the Marina Manager. Maintenance of private moorings is the responsibility of the member. A private mooring, abandoned by a member shall become the property of the club at the start of the next season.

MARINA FITTED EQUIPMENT

The marina system is fitted with electrical outlets (30 Amp and 15 Amp). Anyone wishing 30 Amp electrical power should indicate this on the application form, or in writing to the Marina Manager. There will be a basic charge for electrical power that all marina holders will pay, those using 30 amp power will pay a surcharge. The rates will be established and reviewed at the Annual General Meeting In the interest of safety only CSA approved marine electrical cords will be allowed. Other cords not meeting this criteria will be removed and the member so advised.
Water hoses and hose racks are provided by the club for the use of club members. Members are asked to ensure that the hose is properly flaked back on the rack when finished and that the tap is turned off. Hose is not to be left on the trunk/finger when not manned. Each hose and hose rack is provided to serve the needs of a number of members, and not for the exclusive use of one.

MARINA MAINTENANCE

DYC is responsible for the maintenance of all fingers and trunks.

No member is permitted to alter their finger by the addition of equipment (permanent fenders, cleats, stakes to hold lines, stairs, etc) without the written permission of the Marina Manager. Only equipment approved by DYC may be used. Fingers are not be used as a painting surface without the use of protective plastic between the item being painted and the finger/trunk.

PARKING

The yard has been marked off in a parking grid. Members are permitted parking in this area of the yard. There is NO PARKING at the marina head except to load and unload, and the time limit is set at 15 minutes. Handicap parking is available in the area so indicated by the Handicap Parking Sign.

The club is authorized to issue HRM Police parking violation tickets to cars parked in the handicap area, in the fire lane or exceeding the 15 minute time limit at the marina head. A warning ticket will be issued to first time offenders.

There is a 10 km speed limit anywhere on DYC property.

There is no parking on the paved driveway.

No parking allowed that may interfere with access to launch ramp or travel lift.


BOAT RAMP

Boat Ramp is for the use by DYC Members Only. Non-Members may have use of the boat ramp only if the appropriate fees have been paid in advance. Non-members who have permission to use the ramp may load and unload passengers at a designated area and will be permitted to leave their vehicle and boat trailer on DYC property for a term of 24hrs.

BOAT STORAGE SHEDS

The permission of Management is required, annually, before a boat storage shed is erected. When permission is granted, an invoice will be generated reflecting the fee and the deposit, both amounts set annually. The deposit will be refunded provided the shed is dismantled and the area cleaned by the deadlines as detailed in the following paragraphs.

A request for permission to erect a shed may be made on the form available from the office. Management reserves the right to dictate where the shed is to be located. Yard space is very limited and the number of sheds that will be approved will be limited. Deadline for request submissions is Oct 1 and sheds must be erected and ready for use no later than Oct 15.

All sheds are to be taken down and the area cleaned not later than 1st of June, or within 48 hours of a boat being launched, whichever is the earlier. The shed is to be placed on a cradle and made ready to be moved to a suitable storage area by yard staff. Failure to meet this deadline will result in a penalty fee as set by management. Extensions to the deadline may be submitted to management, prior to the deadline, for approval.



BOAT STORAGE CRADLES

It is the Members responsibility to inspect and maintain their boat while being stored on land. DYC staff will advise the vessel owner of any irreagulatries or safety concerns.

All cradles will be constructed in such a manner as to enable the Travel Lift Trailer to affect a lift. The bunks of the cradle should be so located as to not interfere with the Marine Travel Lift slings.

Cradles will be inspected by the Yard Staff. Staff will determine whether the cradle is fit in all respects to hold the boat and to be transported by the Travel Lift Trailer. Yard staff is authorized to refuse a lift if the cradle is considered to be unsafe.

JACKSTANDS

Jack stands may be rented from DYC for member use.Fees are posted on DYC rate schedule. No lines are to be tied to the jack stands. Member is responsible for providing adequate blocking for the keel of the boat and for the location of the stands placed under the vessel. Proper safety chains must be used in conjunction with jack stands.

DYC staff will have the authority to move any boat in the yard in order to facilitate the regular launching and placement of other vessels at the club. The Member is responsible for the periodic inspection of their vessel while on jack stands.

GENERAL

All pets are to be on a leash at all times. The mess created by them is to be cleaned up and disposed of by the owner. No animals are allowed in Clubhouse.

The rights of others on the marina are to be respected at all times.

No boat will be launched or hauled until all dues/fees have been paid and any outstanding accounts have been rectified. An outstanding account is any account more than 30 days in arrears. A current copy of the insurance carried on the members boat must be on file, and must show that Third Party Liability is included in an amount specified by the Management Committee. The launch/haul of a member’s boat must be booked through the office. At that time, the member’s account will be reviewed and confirmation made that proof of insurance in on file.
No boat shall be removed from the yard/marina, following its sale, until all outstanding dues and fees have been paid.

Certain services may be provided to Non Members upon payment of the fees established by the Management Committee. These services include:

Winter Storage from 15 Oct to 15 May (subject to space being available)
Use of the Travel Lift.
Use of the ramp
Rental of a marina (subject to availability)
Rental of a mooring (subject to availability)
Purchase of fuel/ice or pump out.
The fees charged for these services must be paid in advance.
