Dartmouth Yacht Club Privacy Policy
The Dartmouth Yacht Club recognizes the importance of an individual’s right to privacy. We are committed to the collection and use of personal information gathered in a responsible manner in accordance to the Personal Information Protection and Electronic Document Act (“PIPEDA”) of January 1, 2004.
Collection and Use of Personal Information
The Dartmouth Yacht Club collects personal information from our membership such as name, address, phone numbers, member status, vessel information, e-mail address, and other information pertaining to your membership at this private club. The information gathered is used solely for the purpose of billing and communication to our members. Published material distributed by this club such as the DYC Members Directory, is for internal communications and to assist club members in communication with other members and for club business only. It is not intended for external communications or commercial purposes. The Dartmouth Yacht Club collects personal information in accordance with the law and the consent of individual members either granted or implied. At no time is personal information stored or distributed on the internet.
Disclosure of Personal Information
The Dartmouth Yacht Club shall generally only disclose personal information to a third party:
- In accordance with member direction to provide services on the member’s behalf.
- As required by federal or provincial laws or governing bodies.
- For the purposes of collection of fees owed to the Dartmouth Yacht Club.
The Dartmouth Yacht Club shall disclose personal information only as permitted by law, including the consent of the individual as appropriate.
Consent and Exceptions to Obtaining Consent
The Dartmouth Yacht Club recognizes the importance of obtaining consent where required by law for collection, use and disclosure of personal information. The Dartmouth Yacht Club shall consider the following principles and exceptions as permitted by PIPEDA as consent for obtaining personal information:
- Consent may be expressed or implied depending on the circumstance. Express consent should be obtained when information is likely to be considered sensitive.
- Consent for the DYC Members Directory will be implied unless otherwise instructed by the member.
- In order for consent to be meaningful, the individual shall be notified of the purposes for which the personal information will be used or disclosed at or before the time of collection. When personal information that has already been collected is to be used for a new purpose other than mentioned, the additional consent of the individual shall be obtained and not implied.
- Consent may be given by an authorized person such as legal guardian or persons having power of attorney.
- Subject to contractual, legal and other limitations, consent may be withdrawn by an individual at any time.
Safeguards for Personal Information
The Dartmouth Yacht Club shall make every appropriate effort to ensure the accuracy, safety, and propriety of the information collected and distributed. Any personal information collected shall be retained and stored at the Dartmouth Yacht Club office as long as necessary to fulfill the purposes for which it was intended. No personal information shall be released to persons or companies outside the club without prior permission of the individual.
Rights of the Individual
A member of the Dartmouth Yacht Club whose personal information is in our possession shall upon request be informed of its existence, use and disclosure of his or her personal information and shall be given access to that information. He or she shall be able to challenge the accuracy and completeness of the information and request to have it amended as reasonably as required. The Dartmouth Yacht Club shall make available to its members a copy of this policy and any pertinent information relating to our management of personal information that we deem appropriate for distribution.
Any inquiries from members of the Dartmouth Yacht Club about personal information collected, used, disclosed, or managed shall be directed to our Privacy Officer, Dan Gallina – General Manager at the DYC office.
Changes to this Privacy Policy
Since the Dartmouth Yacht Club regularly reviews it policies and procedures, this privacy policy may be changed from time to time.
